Terms & Conditions

Last updated: September 3, 2026

1. Acceptance of Terms

By creating an account, using the Trident Logistics website or mobile application, or utilising any of our services, you ("Customer," "you," or "your") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms in their entirety, you must not use our services. These Terms constitute a legally binding agreement between you and Trident Logistics (Cayman) Ltd, trading as Trident Logistics ("Trident," "Company," "we," "us," or "our"), a company registered in the Cayman Islands.

2. Services

Trident Logistics provides the following services between the United States (Miami, Florida) and the Cayman Islands:

  • Receiving packages at our Miami warehouse
  • Consolidating packages for ocean freight shipping
  • Customs brokerage via the Cayman Islands Customs Online System (COLS)
  • Vehicle brokerage

We act as a freight forwarding agent and customs broker. We are not a common carrier and do not operate our own vessels. Shipments are carried by third-party ocean freight carriers.

3. Account Registration & Responsibilities

You must register an account to use our services. Upon registration, you will be assigned a unique six-digit account number and a Miami warehouse shipping address.

You agree to:

  • Provide accurate, current, and complete registration information
  • Upload a true and complete purchase invoice for every package, as this is what we declare to Customs on your behalf (see section 7)
  • Keep your login credentials secure and not share them with third parties
  • Notify us immediately of any unauthorised use of your account
  • Register a valid Trader Identification Number (TIN) with Cayman Islands Customs & Border Control, as required by law

You are responsible for all activity that occurs under your account. The actions of any person you authorise to use your account (including authorised persons for package collection) will be attributed to you.

4. Miami Warehouse Address

The Miami warehouse address assigned to your account is the property of Trident Logistics and our warehouse partner. It is provided solely for the purpose of receiving packages on your behalf. You may not use this address for any purpose unrelated to our services. Physical access to the warehouse is restricted to authorised personnel only.

You must include your full name and Trident account number on all packages shipped to the Miami address. Packages received without valid identification may be delayed or returned at your expense.

5. Prohibited & Restricted Items

You agree to comply with all international shipping standards and regulations enforced by the Cayman Islands Customs and Border Control Service (CBC), the laws of the United States, and the laws of any jurisdiction through which the shipment may pass.

You agree not to ship any prohibited items, which include, but are not limited to:

  • Firearms, ammunition, weapons, stun guns, pepper spray, and weapon accessories of any kind
  • Illegal drugs, controlled substances, cannabis, CBD products, drug paraphernalia, and any items referencing marijuana or the cannabis plant
  • Counterfeit currency, negotiable securities, or forged documents
  • Obscene materials, writings, films, or recordings as defined by Cayman Islands law
  • Items named in the Animals Act, the Endangered Species and Propagation Act, the Plants Act, or any other legislation prohibiting or restricting their import into the Cayman Islands
  • Gambling machines and their component parts
  • Items controlled under the US Munitions List (ITAR) or Commerce Control List (CCL) requiring an export licence

Additionally, certain items are restricted, and an official permit, licence, or clearance from the relevant Cayman Islands authority is required before they may be imported into the country. These items include, but are not limited to:

  • Live animals and plants
  • Prescription medications and controlled medicines
  • Fresh fruits and vegetables, fresh/frozen/cured meats, and unprocessed dairy products
  • Explosives of any kind, including commercial and blasting explosives, ammunition, gunpowder, tactical explosives, fireworks, and pyrotechnics
  • Telecommunication devices, radar equipment, and two-way radios
  • Any items whose import is restricted under any law of the Cayman Islands

For more information on prohibited and restricted items under the CBC Act, please visit gov.ky/web/cbc/trade/trade-restrictions.

Trident reserves the right to refuse, return, or dispose of any package containing prohibited items, or restricted items for which the relevant permissions have not been obtained, at the Customer's expense and without liability.

6. Package Inspection

We do not routinely open packages. A package will be opened only in the following circumstances:

  • Where we suspect the contents are illegal or otherwise prohibited under section 5
  • Where Customs & Border Control, or another competent authority in the Cayman Islands or the United States, requires or carries out an inspection

Outside these circumstances your packages are not opened. We do weigh and measure every package for inventory, consolidation, and customs declaration purposes, which does not involve opening it.

Where a package is opened at our Miami warehouse on suspicion and the contents are confirmed to be illegal or prohibited, it will be returned to the sender or disposed of at your expense. Where the contents turn out to be lawful and permitted, the package continues through our service in the normal way.

By using our services, you consent to inspection in the circumstances described above.

7. Customs & Duties

All goods entering the Cayman Islands are subject to customs inspection and payment of applicable import duties.

You authorise Trident to act as your customs broker and to submit declarations to Cayman Islands Customs & Border Control via COLS on your behalf. You warrant that all invoices, item descriptions, and declared values you provide are a true and accurate representation of the contents and fair market value of the goods.

It is a criminal offence under Cayman Islands law to provide false or misleading information to Customs. Failure to declare goods or undervaluation may result in a duty penalty of up to 300% of the assessed value.

Customs duties are payable in addition to Trident's service fees and are not included in our shipping or consolidation charges. We calculate the duty on your goods from their cost, insurance and freight (CIF) value, at the rates set by the Cayman Islands Government.

8. Shipping & Delivery

Shipments travel from our Miami warehouse to Grand Cayman via ocean freight. Estimated transit times are provided for reference only and are not guaranteed. Transit times may vary due to weather conditions, vessel schedules, port congestion, customs processing delays, or other circumstances beyond our control.

Trident is not liable for any loss, damage, or expense arising from delays in delivery. Shipment tracking information is updated at each stage and available through the client portal.

Once your consolidation is ready at our Grand Cayman facility you may collect it yourself at no charge, or request us to deliver it within Grand Cayman. You tell us your preference when you complete your consolidation. If you choose delivery, we will contact you to agree the delivery address and time, and the charge agreed at that point appears on your invoice. Delivery charges, including any free-delivery area or promotional rate then in force, are published at tridentlogistics.ky/pricing. We deliver to the address agreed with you, to you or a person you have authorised to receive the goods.

9. Payment & Fees

Invoices are generated when your consolidation reaches the Processing stage and are due within 3 business days of the date the invoice is issued, unless otherwise agreed in writing. Business days exclude weekends and Cayman Islands public holidays, and the day of issue is not counted. Your invoice states its own due date. Where an invoice is not paid by its due date, a late payment fee may apply. Accepted payment methods include bank transfer, cash, and card.

Our charges include Customs duty, insurance, freight, Port Authority fees, handling, and delivery. Our rates are published at tridentlogistics.ky/pricing and form part of these Terms. Rates may change on notice posted there. A consolidation that has already been invoiced keeps the rates it was invoiced at; a change applies only to consolidations invoiced after it takes effect.

10. Storage & Uncollected Packages

Each package is stored free for 30 days from the date that package is received, while the Customer gathers packages into a consolidation. After that period a storage fee of $2.00 (KYD) per cubic foot per day may be applied to that package, based on its own volume. Packages not consolidated within 40 days of receipt may be returned to the sender, sold or disposed of, at the Customer's expense.

Packages held at our Grand Cayman facility are available for collection or delivery. Customers should arrange collection or delivery within 3 business days of the date the invoice is issued. After this period, a storage fee of $2.00 (KYD) per cubic foot per day may be applied, based on the volume of your consolidation.

Upon arrival at Trident Logistics Cayman Islands location, packages not collected within 30 days of invoice date will be deemed abandoned. Trident may dispose of, donate, or sell abandoned packages without further notice or liability, and the Customer forfeits all rights, title, and interest in the goods.

11. Limitation of Liability

In no event shall Trident be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business, loss of revenue, or loss of opportunity, regardless of the cause of action.

Trident is not liable for loss, damage, or delay caused by: acts of God, natural disasters, war, terrorism, government action, port or carrier strikes, pandemics, cyberattacks, vessel mechanical failure, actions of customs or border authorities, or any other cause beyond our reasonable control.

12. Insurance & Claims

Insurance Coverage and Limits

Insurance coverage is limited to the value of the item(s), therefore no claim can exceed this amount. Insurance coverage begins when your package is delivered to our Miami warehouse and ends 3 business days after you have collected your packages. If, however, your items are collected by a third party, our insurance coverage ends when the packages are handed over to them.

Claims for damaged goods must be submitted in writing through the client portal within 3 business days of receiving your goods, whether collected or delivered, accompanied by photographs and proof of purchase (original invoice or receipt). Customers are also required to keep all damaged goods and its packaging until the claim process is completed.

Insurance claims reimbursements are determined by a third-party insurance provider and not Trident Logistics. Therefore, we have no control over what they reimburse.

Under the following circumstances, the customer cannot file an insurance claim:

  • Packages were not delivered to our Miami warehouse due to the Customer using incorrect address
  • Packages were delivered outside of business hours to our Miami warehouse (Monday–Friday, 9 am–5 pm) and left outside the warehouse facility by the carrier resulting in loss of or damage to packages
  • For fragile items e.g. glassware, electronic items and the packaging by the supplier, sender or manufacturer is deemed inadequate for export purposes

Items excluded from insurance coverage

Our shipping and insurance coverage policy does not cover the following items:

  • Money and Negotiable Documents: Cash, currency, coins, bullion, stamps, deeds, notes, stocks, bonds, and gift certificates.
  • Valuable documents: accounts, bills, notes, securities, stock certificates passports, tickets, deeds, trading stamps, valuable papers or documents, manuscripts, recorded or electronic media and similar items

13. Indemnification

You agree to indemnify, defend, and hold harmless Trident Logistics, its directors, officers, employees, agents, and warehouse partners from and against any and all claims, actions, demands, liabilities, losses, damages, judgments, penalties, fines, expenses, and costs (including reasonable legal fees) arising out of or related to: (a) your use of our services; (b) your breach of these Terms; (c) inaccurate, false, or incomplete information provided by you, including customs declarations; (d) prohibited or restricted items shipped by you; (e) your failure to pay customs duties or fees; or (f) any violation of applicable law.

14. Lien on Goods

Trident holds a general lien on all goods, documents, and funds in our possession or control for any and all sums due from you, including shipping charges, customs duties, storage fees, and any other costs. If payment is not received within 30 days, Trident may sell, auction, or dispose of the goods to satisfy the outstanding balance, without further notice or liability.

15. Account Suspension & Termination

You may close your account at any time by contacting us, provided all outstanding balances are paid and all packages have been collected.

Suspension is temporary and is used where something can be rectified by you. While an account is suspended you cannot sign in or start a new consolidation, and we will not release packages, but nothing is deleted and your packages remain yours. The account is restored once the matter is resolved. We may suspend an account for:

  • An invoice that is unpaid after its due date
  • Packages left uncollected beyond the collection window in section 10
  • Failure to provide documentation we have asked for, including a valid TIN or proof of identity
  • Any other breach of these Terms that you are able to rectify

Termination ends the relationship and is permanent. We may terminate an account immediately and without prior notice for:

  • Providing false customs declarations or fraudulent documentation
  • Shipping prohibited items
  • Unlawful use of our services
  • Abusive or threatening behaviour towards our staff
  • A breach that is not rectified while the account is suspended, or the repetition of one that was

Under either, you remain liable for all outstanding charges, and storage continues to accrue on packages we are holding. Upon termination, packages in our possession will be held for 30 days, after which they are treated as abandoned under section 10. We retain records after termination where the law requires it of us as a customs broker; our privacy policy sets out for how long.

16. Force Majeure

Trident shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, hurricanes, floods, earthquakes, pandemics, epidemics, war, terrorism, civil unrest, government sanctions, trade embargoes, port closures, carrier strikes, labour disputes, vessel breakdown, cyberattacks, or interruptions to utility services.

17. Intellectual Property

All content on the Trident Logistics website and client portal, including text, graphics, logos, trademarks, and software, is the property of Trident Logistics or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. We will notify registered customers of material changes via portal notification. Your continued use of our services after any changes constitutes acceptance of the updated Terms.

19. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Cayman Islands. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Cayman Islands.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
